If a dispute arises under this agreement, we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Hunterdon, New Jersey. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us.
If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Hunterdon, New Jersey, under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.
If any provision of this agreement is void or unenforceable in whole or in part, the remaining provisions of this Agreement shall not be affected thereby.
Termination
These Terms of Use agreement are effective until terminated by either party. You may terminate this agreement at any time by destroying all materials obtained from any and all ThirdParent site(s) and all related documentation and all copies and installations thereof, whether made under the terms of this agreement or otherwise. This agreement will terminate immediately without notice at ThirdParent's sole discretion, should you fail to comply with any term or provision of this agreement. Upon termination, you must destroy all materials obtained from this site and any and all other ThirdParent site(s) and all copies thereof, whether made under the terms of this agreement or otherwise.
ThirdParent strives to offer its clients the many advantages of internet technology and to provide thorough and personalized reporting. We may use Personally Identifiable Information (your name, e-mail address, street address, school name) subject to the terms of this privacy policy. We will never sell, barter, or rent your email address to any unauthorized third party. Period.
How we gather information
How we collect and report information depends on the pages the subject has visited, the activities in which the subject elected to participated or the information posted to or by the subject to the internet. You may be asked to provide information when you register. Like most Web services, ThirdParent also collects information automatically and through the use of electronic tools. As we adopt additional technology, we may also gather information through other means. In certain cases, you can choose not to provide us with information. We are looking, for the sole purpose of reporting back to you, evidence of the subject’s sites visited and information posted there by or about the subject. Such evidence may include photos or video, however, viewing or evaluating such photos or video is not our intention. Our standard audit will include but may not be limited to all material originally posted to the internet or social media for a period of one year prior to initiating the audit. In the event that we do find something potentially objectionable, our actions will be limited to reporting such content back to you. In no event will that content be stored on our computers or servers or reported or transmitted to any third party, however, ThirdParent, at its’ discretion, may choose to or be required to turn over or make available message or other content to appropriate personnel or law enforcement agencies.
We will return to you, in some cases via an encrypted file, audit results including all applicable information regarding the subject in a timely manner. In the event that no information related to the subject is found, the consultant will notify the client of such findings. Any information obtained by the consultant will not be used by the consultant in any way, with the exception of delivering said information to the client. The client acknowledges that any information or content obtained by the consultant in the course of the search, including content depicting racism, bullying, slander, explicit sexuality, illegal acts, or anything else, was obtained at the request of the client for the sole purpose of reporting back to the client. In the event that we find something that, in our opinion, requires reporting to police or other authorities, we may be forced to do so. You acknowledge that the search conducted by the consultant will be on a best efforts basis, limited to information in the public domain and may change at any point after the initial search is performed. In addition, material previously posted on the internet by or about the subject may have already been deleted. The accuracy or completeness of the results delivered will be at least in part determined by the completeness of the information provided by the client. In cases where the subject uses an alias, false personal information or otherwise attempts to obscure true identification, results may be incomplete. In addition, information posted by or about the subject solely to a private network will be in most cases not available to us, and you should assume as such.
The consultant reserves the right to assign subcontractors as needed to this project to ensure on-time completion. The provisions of the Agreement shall be binding upon and shall inure to the benefit of the Parties hereto, their heirs, administrators and successors. Results obtained by the consultant or its affiliates cannot be guaranteed in any way.
Information that does not personally involve or depict the subject will not be used. We may use Personally Identifiable Information collected on ThirdParent to communicate with you about your registration and customization preferences; our Terms of Service and privacy policy; services and products offered by ThirdParent and other topics we think you might find of interest.
Personally Identifiable Information collected by ThirdParent may also be used for other purposes, including but not limited to site administration, troubleshooting, processing of e-commerce transactions, general administration, and other communications with you. Certain third parties who provide technical support for the operation of our site (our Web hosting service for example) may access such information. We will use your information only as permitted by law. In addition, from time to time as we continue to develop our business, we may sell, buy, merge or partner with other companies or businesses. In such transactions, user information may be among the transferred assets. We may also disclose your information in response to a court order, at other times when we believe we are reasonably required to do so by law, in connection with the collection of amounts you may owe to us, and/or to law enforcement authorities whenever we deem it appropriate or necessary. ThirdParent does not knowingly collect or solicit information from or about children under 13 except as permitted by law. If we discover we have received any information from a child under 13 in violation of this policy, we will delete that information immediately.
